Regulatory Enforcement and Sanctions Bill


Key Benefits

The Bill would establish the Local Better Regulation Office, bringing consistency to local authority enforcement; it would put in place a range of administrative sanctions for regulatory non-compliance that would complement existing criminal sanctions, and require that regulators would not maintain or impose unnecessary burdens.

Reducing unnecessary burdens imposed on business by local authority regulatory services by promoting consistent, proportionate, effective and risk-based enforcement by trading standards and environmental health services;

Enabling regulators to access a set of alternative administrative sanctions that complement existing criminal sanctions and aim for better regulatory compliance by business;

Ensuring unnecessary burdens are not imposed on business by regulators.

To establish the Local Better Regulation Office as a statutory corporation and to confer on it five key functions:

Issuing guidance to local authorities;

Supporting best practice by local authorities;

Giving advice to Ministers;

Reviewing and updating the Government's list of national regulatory priorities; and

Promoting consistent regulatory enforcement by local authorities.

Delivering four of the recommendations of the Macrory Review by providing for expanded regulatory sanctioning powers.

Providing a power to require regulators not to impose or maintain unnecessary burdens.
